GENERAL TERMS AND CONDITIONS OF SALE AND GUARANTEES

ODUXIO SRL – AnceFlex® Products

Introduction

The present General Terms and Conditions of Sale (GTC) govern the sales of products offered by the company ODUXIO SRL, particularly through its websites and online stores.

They define the rights and obligations of the parties (seller and buyer) concerning, in particular:

  • the sale of products
  • the right of withdrawal
  • the guarantees
  • the complaints
  • the responsibilities.

These conditions are established in accordance with the Belgian law, particularly at Code of Economic Law.

All orders imply full and complete acceptance of these conditions.

Article 1: Purpose and scope

1.1 These conditions apply to all sales of products marketed by ODUXIO SRL, particularly under the brand AnceFlex®.

1.2 ODUXIO SRL markets exclusively products.
No services are sold under these conditions.

1.3 These terms and conditions govern the contractual relationship between:

  • ODUXIO SRL (the seller)
  • and any person making a purchase (the buyer).

Article 2: Right of withdrawal

2.1 In accordance with Belgian Code of Economic Law, the buyer has a period of 14 calendar days from the date of receipt of the product to exercise the right of withdrawal.

2.2 The buyer must notify their decision to withdraw by email or in writing.

2.3 The product must be returned within 14 days of the notification of withdrawal.

2.4 To be accepted, the product must:

  • be in its original state
  • be not used
  • be complete
  • to have returned in its original packaging
  • to have returned in its original, undamaged packaging
  • include all accessories and documents supplied.

2.5 Any returned product:

  • damaged
  • used
  • incomplete
  • or without its original packaging and packing

maybe refused or subject to depreciation.

2.6 Return shipping costs are the sole responsibility of the buyer., unless the product is defective or in the event of an error attributable to ODUXIO SRL.

Article 3: Legal guarantee of conformity

3.1 In accordance with articles Articles 1649bis to 1649octies of the Belgian Civil Code, the products benefit from the legal guarantee of conformity.

3.2 This warranty covers defects existing at the time of delivery.

3.3 The duration of the legal guarantee is 2 years from the date of delivery of the product.

3.4 In the event of a lack of conformity, the buyer may request:

  • product repair
  • product replacement
  • or, if that is not possible, a price reduction or termination of the contract.

Article 4: Commercial Guarantee

4.1 ODUXIO SRL may offer a 2-year commercial warranty covering manufacturing defects.

4.2 This guarantee does not cover:

  • normal wear and tear
  • misuse
  • use not in accordance with instructions
  • an unauthorized modification or repair
  • accidental damage.

4.3 All warranty claims must be accompanied by:

  • of a proof of purchase
  • of complete product
  • of all the accessories provided.

Article 5: Seller's Obligations

ODUXIO SRL is committed to:

  • deliver products that conform to the order
  • to provide products free from manufacturing defects
  • handle complaints within a reasonable timeframe.

In the event of a proven defect, ODUXIO SRL may:

  • repair the product
  • replace the product
  • offer a refund if necessary.

Article 6: Buyer's Obligations

The buyer agrees to:

  • check the condition of the package upon receipt
  • report any damage as soon as possible
  • Use the products according to the instructions.

Any improper use that may result in damage voids the warranty.

Article 7: Limitation of Liability

7.1 ODUXIO SRL cannot be held liable for:

  • indirect damages
  • revenue losses
  • operating losses
  • data loss.

7.2 The maximum liability of ODUXIO SRL is limited to amount paid for the product in question.

7.3 The products must be used in accordance with their intended purpose and the instructions provided.

Article 8: Force majeure

ODUXIO SRL cannot be held liable for any delay or non-performance resulting from an event of force majeure, notably :

  • natural disasters
  • strikes
  • infrastructure failures
  • government decisions
  • logistical disruptions.

Article 9: Complaints and Customer Service

All complaints must be addressed to ODUXIO SRL's customer service department as soon as possible.

ODUXIO SRL will strive to find an amicable solution as soon as possible.

Article 10: Disputes

These terms and conditions are governed by Belgian law.

In the event of a dispute, the parties will first seek a amicable solution.

In the absence of an agreement, the competent courts of Brussels will be the only ones competent.
