General conditions of sale

Introduction

This document sets out the general terms and conditions applicable to product sales by ODUXIO SRL, including the rights and obligations of the parties (seller and buyer) regarding warranty, claims, and the right of withdrawal. These terms and conditions comply with current Belgian law and aim to protect the interests of both parties while ensuring maximum transparency.

Article 1: Purpose and scope

1.1 These conditions apply to all products marketed by ODUXIO SRL.

1.2 They aim to regulate the relationship between the buyer and the seller, covering in particular product warranty and the right of withdrawal.

Article 2: Right of withdrawal

2.1 In accordance with Belgian consumer protection legislation (Code of Economic Law), the buyer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to provide a reason.

2.2 To exercise this right, the buyer must notify ODUXIO SRL by any means (email, mail) and return the product within 14 days of this notification.

2.3 The product must be returned in its original, undamaged packaging, along with all accessories and documents provided. The product must show no signs of wear or damage, otherwise the return will be refused.

2.4 Return shipping costs are the responsibility of the buyer, unless otherwise stated by ODUXIO SRL.

Article 3: Legal guarantee of conformity

3.1 In accordance with Articles 1649bis to 1649octies of the Belgian Civil Code, all products sold by ODUXIO SRL are covered by the legal guarantee of conformity. This guarantee covers defects of conformity existing at the time of delivery of the product.

3.2 The duration of this warranty is 2 years from the date of delivery.

3.3 In the event of a lack of conformity, the buyer may choose between repair of the product, its replacement or, failing that, a reduction in price or termination of the contract, subject to the conditions provided for by law.

Article 4: Commercial Guarantee

4.1 In addition to the legal guarantee, ODUXIO SRL offers a commercial guarantee for a period of 2 years, covering defects in materials and workmanship.

4.2 The commercial warranty does not cover damage caused by misuse, negligence, modification or unauthorized repair.

4.3 To benefit from the commercial warranty, the buyer must present proof of purchase and return the product, with all its accessories, in a clean and well-maintained condition.

Article 5: Seller's Obligations

5.1 ODUXIO SRL undertakes to deliver products that conform to the contract and are free from defects.

5.2 In the event of a valid claim, ODUXIO SRL will ensure the repair or replacement of the product at no additional cost to the buyer, unless this proves impossible or disproportionate.

Article 6: Buyer's Obligations

6.1 The buyer is required to check the condition of the product upon delivery and to report without delay any defects or anomalies found.

6.2 The buyer must use the product in accordance with the manufacturer's instructions. Any misuse that may result in premature wear or damage will void the warranty.

Article 7: Limitation of Liability

7.1 Under no circumstances shall ODUXIO SRL be liable for indirect, consequential, or punitive damages, including loss of revenue, profits, or business opportunities.

7.2 The total liability of ODUXIO SRL under a sales contract is limited to the amount actually paid by the buyer for the purchase of the product in question.

Article 8: Force majeure

8.1 ODUXIO SRL will not be held liable for any delay or failure to perform its obligations due to unforeseeable and irresistible events (force majeure), such as natural disasters, strikes, power outages, or government measures.

Article 9: Complaints and Customer Service

9.1 Any complaint relating to a product must be addressed to the customer service department of ODUXIO SRL as soon as possible, by email or mail.

9.2 ODUXIO SRL undertakes to process the complaint within a reasonable time and to find an amicable solution with the buyer.

Article 10: Disputes

10.1 These conditions are governed by Belgian law.

10.2 In the event of a dispute, the parties agree to seek an amicable solution before resorting to the courts. Failing that, the courts of Brussels shall have jurisdiction.
