Terms and conditions of sale

Introduction

This document sets out the general conditions applicable to sales of products by ODUXIO SRL, including the rights and obligations of the parties (seller and buyer) concerning warranty, claims and right of withdrawal. These conditions comply with current Belgian laws and aim to protect the interests of both parties while ensuring maximum transparency.

Article 1: Purpose and scope

1.1 These terms and conditions apply to all products marketed by ODUXIO SRL.

1.2 They are intended to regulate the relationship between buyer and seller, covering in particular product warranty and right of withdrawal.

Article 2: Right of withdrawal

2.1 In accordance with Belgian consumer protection legislation (Code of Economic Law), the buyer has a period of 14 calendar days from receipt of the product to exercise his right of withdrawal, without having to provide a reason.

2.2 To exercise this right, the buyer must notify ODUXIO SRL by any means (e-mail, post) and return the product within 14 days of such notification.

2.3 The product must be returned in its original packaging, undamaged, and accompanied by all accessories and documents supplied. The product must not show any signs of wear or damage, under penalty of refusal of the retraction.

2.4 Return shipping costs are at the buyer's expense, unless otherwise specified by ODUXIO SRL.

Article 3: Legal warranty of conformity

3.1 In accordance with articles 1649bis to 1649octies of the Belgian Civil Code, all products sold by ODUXIO SRL benefit from the legal guarantee of conformity. This warranty covers defects in conformity existing at the time of delivery of the product.

3.2 The duration of this warranty is 2 years from delivery.

3.3 In the event of lack of conformity, the purchaser may choose between repairing the product, replacing it or, failing that, reducing the price or rescinding the contract, subject to the conditions laid down by law.

Article 4 : Commercial warranty

4.1 In addition to the legal warranty, ODUXIO SRL offers a 2-year commercial warranty, covering defects in materials and workmanship.

4.2 The commercial warranty does not cover damage caused by misuse, neglect, modification or unauthorized repair.

4.3 To benefit from the commercial warranty, the purchaser must present proof of purchase and return the product, with all accessories, in a clean and well-maintained condition.

Article 5: Seller's obligations

5.1 ODUXIO SRL undertakes to deliver products that conform to the contract and are free from defects.

5.2 In the event of a justified complaint, ODUXIO SRL will ensure the repair or replacement of the product at no additional cost to the buyer, unless this proves impossible or disproportionate.

Article 6: Buyer's obligations

6.1 The purchaser is obliged to check the condition of the product upon delivery and to report any defects or anomalies without delay.

6.2 The purchaser must use the product in accordance with the manufacturer's instructions. Any misuse that may result in premature wear or damage will exclude warranty coverage.

Article 7: Limitation of liability

7.1 In no event shall ODUXIO SRL be liable for indirect, consequential, or punitive damages, including loss of revenue, profits, or business opportunities.

7.2 ODUXIO SRL's total liability under a contract of sale is limited to the amount actually paid by the purchaser for the purchase of the product in question.

Article 8: Force majeure

8.1 ODUXIO SRL will not be held liable for any delay or non-performance of its obligations due to unforeseeable and irresistible events (force majeure), such as natural disasters, strikes, power outages, or government measures.

Article 9: Complaints and customer service

9.1 Any complaint relating to a product must be addressed to ODUXIO SRL's customer service department as soon as possible, by e-mail or post.

9.2 ODUXIO SRL undertakes to deal with the complaint within a reasonable time and to find an amicable solution with the buyer.

Article 10: Disputes

10.1 These conditions are governed by Belgian law.

10.2 In the event of a dispute, the parties undertake to seek an amicable solution before resorting to the courts. Failing this, the courts of Brussels shall have jurisdiction.
